1. I engage in the hire of Go-Karts at my own risk and have been provided with the Kart and safety helmets in good condition. 2. I understand that as a condition of hire, I wear a helmet and enclosed shoes at all times. 3. I will take full control of the equipment and assume total responsibility. Only those listed below are to operate the Kart. Passengers will not exceed the number of seats on the Go-Kart. 4. I agree to operate the Kart in the designated areas only and will not exceed 5km/h. 5. Use of the Karts is considered strenuous activity. I confirm that I and the others listed below are in good health and not suffering from medical conditions that may be aggravated by physical exertion. 6. I agree that no alcohol or drugs will be consumed before or during the hire. 7. I will be fully responsible for any loss or damage to the equipment and accessories or damage to third party property and agree to pay for any such loss or damage. 8. I will return the equipment at the specified time and understand late returns may result in additional charges. 9. Staff of BIG4 Caloundra have the right to take possession of the Karts at any time during the period of hire for failure to observe the above rules. 10. I agree and contract to absolve BIG4 Caloundra of liability which may arise under the law of negligence through the use, operation, hiring, repair or condition of the equipment / activity which is the subject of this contract. I further agree and contract to absolve BIG4 Caloundra of all liability which may arise under the law of negligence through the giving of instructions, advice or equipment in relation to the matter of safety in the use and operation of said equipment / activity.
